Position Objective

This position is responsible for managing the contractual process from beginning to end. This includes but is not limited to contract development, negotiation, proposal preparation, contract administration and creation of new agreements to support SMEs and their strategic growth areas. This will ensure agreements align with business initiatives and ascertain proper contract formation with all parties involved and in accordance with company policies and legal requirements.

Essential Job Functions

  • Analyze complex financial and business concepts to identify significant business issues and financial or legal risks.
  • Manage the full contract process, conceptualize, make recommendations and facilitate team consensus to move forward during negotiations.
  • Provide risk assessment of contract terms and issues and offer alternate approaches to mitigate risk, including use of alternate contractual language. Recommend viable alternatives during the negotiation process to maximize business opportunities for KMBS and its clients.
  • Develop and implement contracting policies and new contract terms. Initiate and pursue process improvement initiatives. Recommend and implement process and procedure improvements.
  • Provide feedback to business teams regarding potential operational and financial issues raised in customer RFP’s and Terms and Conditions.
  • Identify and elevate issues and risk exposure to executive management, marketing and sales teams.
  • Lead internal project and strategy meetings. Focus on joint problem-solving with cross functional teams and stakeholders.
  • Lead efforts to ensure key initiatives and strategies align with the priorities set forth by KMBS. Build strong internal and external networks, including relationships with business executives to facilitate deal closures.
  • Create and provide contract analysis, metrics and reporting for executive management.
  • Develop and administer contract database and filing system.
  • Maintain and develop expertise across all portfolios.
  • Manage, coach and mentor the strategy and operations of the assigned team members.
  • Ensure compliance with all corporate policies and directives.
  • Manage projects as assigned

Competencies (Knowledge, Skills and Abilities)

  • Broad knowledge and experience with all phases of contract negotiation/management and sales administration
  • Experienced with contract writing and strong knowledge of contractual terms and conditions
  • Experience with negotiating global contracts
  • Detailed-oriented with superior reading comprehension skills related to accuracy and thoroughness
  • Excellent verbal/written communication skills
  • Ability to work collaboratively with teams and independently
  • Ability and confidence to interact with all levels, including executive management
  • Strong organizational and time management skills required
  • Ability to multi-task and meet strict deadlines in a fast-paced environment
  • Ability to train and support team in gaining a stronger understanding of contract terms and their relevance
  • Legal industry experience preferred
  • Must possess broad industry knowledge, specifically, Managed Print Services, IT Services, ECM, Facilities Management, Healthcare and Global capabilities.
  • Able to develop a thorough understanding of all KMBS systems to fully support the sales efforts.
  • Highly proficient in Microsoft Office

Experience, Educational Reqts and Certifications

  • Bachelor’s Degree in Business or related field. M.B.A. preferred.
  • 5 years of experience in a related field as an individual contributor.
  • 3-5 years of contract negotiations and risk management experience.
  • 1-3 years of supervisory experience.
